A settlement has been reached in court after accusations surfaced regarding an alleged violation of the American With Disabilities Act (ADA) involving a business in Point Pleasant Borough.
The U.S. Attorney's Office announced that they've reached a settlement with USA Nails Inc., located in a shopping plaza on Bridge Avenue in Point Pleasant Borough, to "resolve allegations" after they allegedly discriminated against people with mobility impairments which violates the ADA.

As a result of the settlement reached, USA Nails Inc. of Point Pleasant has agreed to adopt and post a non-discrimination policy in a spot where everyone can see it as well as hold ADA Title III training for employees and also pay $1, 000 in damages to the complainant, according to U.S. Attorney Philip R. Sellinger.
USA Nails Inc. of Point Pleasant had been accused of discrimination by refusing service to people with mobility impairments and required the use of a wheelchair.
“Disability discrimination violates the ADA and cannot be tolerated, ” Sellinger said in a written statement. “This agreement ensures that customers will not be turned away from receiving nail services simply because they happen to have a disability.”

Sellinger said that in this case settlement, the government is represented by Senior Civil Rights Counsel Kelly Horan Florio of the U.S. Attorney’s Office Civil Rights Division in Newark.
